TikTok law upheld: Supreme Court backs Congress's authority over Chinese ownership

U.S. Representative Dusty Johnson (R-S.D.), who serves on the Select Committee on China, issued a statement in response to the United States Supreme Court's decision regarding TikTok. The court unanimously affirmed that Congress can require TikTok to separate from its Chinese ownership.

Johnson stated, "It’s no secret that TikTok is malware by the Chinese Communist Party," and expressed concerns about the app promoting Chinese propaganda and collecting sensitive data from American users. He added, "I’m glad the Supreme Court voted to uphold the bill that forces TikTok to cut ties from the Chinese Communist Party in order to continue operating in the U.S."

Johnson played a role in advancing this legislative effort as a co-sponsor of the Protecting Americans from Foreign Adversary Controlled Applications Act, which was approved by the House in April 2024. His history of opposing TikTok includes introducing legislation like the Block the Tok Act in 2022, aiming to eliminate TikTok from federal government devices.

The Protecting Americans from Foreign Adversary Controlled Applications Act seeks to remove apps backed by ByteDance, including TikTok, from American app stores and web hosting services unless they sever connections with entities under foreign adversary control.
